NESA Privacy Policy

NESA is committed to protecting the privacy of its member's and any other individuals who have dealings with us.  This policy explains how we handle your personal information including the use and any disclosure of your personal information, as well as your right to access the personal information we hold on you. 

What we do

The National Employment Services Association, NESA, exists to advance the interests of the Employment Services Industry in Australia on behalf of its members. It undertakes a range of activities to promote a viable and sustainable employment services industry. NESA Membership may be taken by any provider of Government contracted employment services including organisations individuals (individual or associate membership) and businesses (corporate membership). 

Services we provide

NESA provides members and with a broad range of membership services including advocacy, representation, professional development, professional advice, policy advice and development, the provision of education, training, and information and networking opportunities.

What personal information does NESA collect?

In order to provide members with the services listed above, we collect personal information from members. The main information we need is how best to contact the nominated business/corporate or individual member. However, in order to meet member's needs we may also collect other information including information on special interests, business details such as number of offices/sites, other nominated staff to contact (contact details), and method of payment for services.

Occasionally NESA may collect information on people who are not members of NESA. For example, we may collect information on individuals who wish to access a NESA service or who nominate for or are nominated for a NESA Award.  Such people may be clients of a NESA member such as a jobseeker or employer, or a staff member of a member or they may be a non member working in the employment services industry.

We may collect:

  • Your name;
  • Your work address;
  • Your email address;
  • Your telephone number (including mobile phone number);
  • Credit card or other financial information (for payment of services);
  • Information on areas of special interest; and
  • Information on personal views and opinions (such as that contained in submissions from members on various topics of interest and relevance to NESA members. This information is de-identified for external use).
  • If you are an award nominee, we may collect additional information about you as per the award nomination form

Why do we need your personal information?

We need to collect your personal information so that we are able to provide you with membership or other services listed above, particularly to advise you about NESA initiated or sponsored activities, events or other developments that may be of interest to you or your organisation.

If you are an award nominee, we collect information as per the award nomination form when you are nominated for a NESA award to assess your nomination. This information is provided by the nominating agency (a NESA member).

When do we collect your personal information?

NESA collects personal information from you when you provide it to us by any of the following means:

  • Filling in an application for membership;
  • When your employer provides the information to us (as part of Corporate Membership staff website access);
  • When you register for a service e.g. workshop; professional development, Special Interest Group, Conference etc;
  • When you provide NESA with your views, opinions or attitudes about particular issues or matters of interest to members;
  • When you contact NESA by any means (email, fax, phone, website etc) regarding any other service provision e.g. advice, information, query, training etc.
  • When you are nominated for an award

Who do we collect information from?

Where-ever possible, we will try to collect personal information directly from you (the individual who the information relates to).  Occasionally we may collect information from a third party, usually an employer in the case of NESA Corporate Membership as Corporate Membership entitles the business to register employees for website access and to provide information on how to contact staff at other company sites.

Sometimes we may collect information from a third party such as a NESA member who is nominating a client or employer for a NESA award, or we may collect information from a contractor such as a conference organiser or training partner who is acting on our behalf.

At, or as soon as practicable after the time NESA collects your personal information we will take reasonable steps to ensure that you are made aware of:

  • Who we are and how you can contact us;
  • Your rights with regard to accessing the personal information we hold on you;
  • The purpose for which your personal information was collected;
  • To whom we usually disclose your personal information to;
  • Any law that requires us to collect particular personal information; and
  • The main consequences, if any, for you if you do not provide all or part of the information we require.

NESA will only collect personal information by fair and lawful means and not in an unreasonably intrusive manner.

How does NESA use your personal information?

NESA uses your personal information to provide you with

  • Membership services (as detailed above) that you have requested or are entitled to access
  • Other services, including new services provided by other parties that we believe you may reasonably expect us to provide
  • As part of a submission or report to external parties (usually, all personal information including opinion is de-identified)
  • As part of an awards process

NESA may also use and disclose your personal information for another purpose if:

  • You would reasonably expect us to disclose it for that purpose;
  • That purpose is related to the purpose specified to you at the time of collection;
  • NESA reasonably believes that the use is necessary to lessen or prevent a serious and imminent threat to an individual's life or health;
  • NESA has reason to suspect that unlawful activity has been, or is being engaged in, and uses the information as part of its investigation, or in reporting its concerns to the relevant authority;
  • The use and disclosure is specifically authorised by law; or
  • The use and disclosure is reasonably necessary for the enforcement of the criminal law, a law imposing a pecuniary penalty, or for the protection of the public revenue.
  • You have consented to us doing so as part of an awards process.

NESA does not use or disclose your personal information for the purposes of direct marketing of unrelated products or services.

Does NESA share your personal information with others?

NESA may share your personal information if appropriate with other NESA members via our secure website or other method, for example via Special Interest Groups, Annual Conference participation list etc.

We may occasionally share your personal information with other parties so that they may provide a service to you on NESA's behalf, for example our annual conference organiser. Such parties will be required to comply with NESA's Privacy Policy

NESA may share your views, attitudes or opinions with others, but will always de-identify any material before it is released.

NESA may share your information with the media as part of an awards promotion effort or as part of our work to promote the employment services industry. We do this only with the expressed consent of the individual concerned.

NESA will not reveal, disclose, sell, distribute, rent, license, share or pass your personal information on to any third party, other than those service providers that we have a binding agreement with ensuring that the third party affords your personal information similar levels of protection as we do.

  • Conference organisers
  • Workshop providers NESA's Training Partners
  • Professional consultants
  • Contractors
  • Media (with express consent as part of awards process)

How do we keep your information up to date and safe?

We will make sure that the information you provide to us remains secure, private and is used only for the purposes you agree to.  NESA will also take reasonable steps to ensure that your personal information is accurate, complete and up-to-date. For members, an organisation administrator nominated by your company will also have access to updating your personal details held on the NESA database.

At NESA we are committed to protecting the privacy of your personal information.  We take reasonable steps to protect your personal information from misuse, loss and from unauthorised access, modification or disclosure.  We ensure this by having such security measures as:

  • Individual password access to systems and databases;
  • Secure file cabinets; and
  • Secure access to our offices.

We will also take reasonable steps to destroy or permanently de-identify personal information if it is no longer required for any purpose.

The Internet and Your Privacy

NESA uses the World Wide Web in order to assist you with policy development and advice, industry services, information, education and training, and practice and professional development services.  The following statement outlines how in the context of our website your information is protected and recorded.  By accessing the members only parts of this site members consent to the uses and disclosures outlined previously in this privacy policy.

Security

NESA uses the Secure Sockets Layer (SSL) protocol to safeguard your sensitive personal information, including your credit card number, during online transactions. It also ensures that the site you're doing business with is the site you think it is. Using this widely accepted form of encryption, your transaction is secured from your personal computer to the NESA computer processing your request in a way that is extremely difficult for anyone else to decode. The NESA processing computers are located behind a secure firewall. For your protection, never put your credit card number or other sensitive information in unencrypted e-mail. For added security, your credit card information is not stored on the NESA database and only authorized employees have access to your credit card number for card processing purposes before it is securely destroyed.

SSL is highly regarded to be a very safe encryption method; however, we cannot fully guarantee the security of your information. Transmission is at your own risk.

NESA uses a range of security measures, including password access to member services available on the NESA website. By accessing the password protected sections of the website, users are deemed to agree to NESA's password security policy which states that login details should be kept secure and not be made available to any other persons or organisations.

Our web site contains links to other sites, which are not subject to our privacy standards, policies and procedures. You will need to review those web sites directly to ascertain their privacy policies and practices.

Cookies 

NESA's website uses cookies.  Cookies are pieces of information that a website can transfer to an individual's computer for record keeping.  Cookies make using our website easier to navigate by storing your individual preferences.  This will enable you to take full advantage of the services that www.nesa.com.au offers. The use of cookies is a widely used industry standard and most major websites use them. You may configure your hard-drive to not accept cookies; however you may lose some functionality.

How can you find out what information NESA has about you?

You may find out what personal information we hold on you and you may correct that information if it is incorrect.

You will be required to provide adequate proof/verification of your identity before we provide you with any personal information.

There may be some cases where we are unable to provide you access to your personal information; however NESA will explain the reasons why if access was denied. We do refuse access if it would interfere with the privacy rights of other persons or if it breaches any confidentiality that relates to that information. Anonymity

Whenever it is lawful or practicable, you will have the option of not identifying yourself when dealing with NESA. However in order for us to provide membership services, we generally require that you identify yourself.

Sensitive Information 

If NESA collects any sensitive information, (such as health or other information) we seek consent from the person this information relates to, and expressly seek consent before any sensitive information is released to other parties...
